    A Portage County man who was firing shots to warn suspected intruders killed one of them early Tuesday, officials said.

    Gregory Goldfuss, 23, of Windham was found fatally shot shortly after midnight by sheriff's deputies.

    Gene Davidson, 50, of state Route 88 in Freedom Township was telephoned by neighbors who thought they heard someone trying to break into his storage barn, said Sheriff P. Ken Howe.

    Davidson went out on his porch and yelled at two men on his property, Howe said. When the men didn't move, Davidson randomly fired three or four warning shots with his .38-caliber handgun, Howe said. The barn is about 75 feet from Davidson's home.

    Sheriff's deputies were summoned by telephone, and they found Goldfuss' body in the front yard; the other man had fled, Howe said. Davidson apparently didn't know someone had been shot, Howe said. The bullet entered the back of Goldfuss' right arm and was lodged in his right lung.

    Portage County Coroner Robert Sybert pronounced Goldfuss dead at 1:45 a.m. `I really don't think he (Davidson) meant to kill him,' Howe said. No charges have been filed against Davidson.

    Davidson declined to comment on the incident until after the sheriff's investigation is complete.

    Sheriff's deputies interviewed the man who had been with Goldfuss, as well as other acquaintances, but Howe wouldn't release more details.

    Funeral arrangements for Goldfuss are pending. slb

    Portage County Sheriff P. Ken Howe said Wednesday, that no charges are likely to be filed against Gene Davidson, the Freedom Township man who shot and killed a suspected intruder.

    Gregory Goldfuss, 23, was killed early Tuesday, morning in the front yard of Davidson's home. Davidson thought Goldfuss and another man, whom Howe wouldn't name, were trying to break into a storage barn and randomly fired shots to warn the men, Howe said.

    In most cities, it is illegal to discharge a firearm, Howe said. But no such law applies in the township where the incident occurred, he said.

    After the sheriff's deputies complete the investigation, the case will be turned over to the Portage County prosecutor's office for a grand jury to consider, said Assistant Prosecutor James Aylward.

    Mr. Goldfuss, a drywall installer from Windham, is survived by his wife, Candy, and 16-month-old son, Gregory.

    Calling hours for Mr. Goldfuss will be from 3 to 5 p.m. and from 7 to 9 p.m. today, at the Johnson-Romito funeral home in Bedford. The funeral will be Friday. Call the funeral home at 232-1441 for the time of the service. ds

    SLAIN TRESPASSER'S FAMILY OWED $150,000 IN DAMAGES

    The family of a trespasser killed by a Portage County homeowner has the right to collect damages, the Ohio Supreme Court ruled yesterday.

    DEATH: The reason was not so much that the family was entitled to the money requested in the civil suit. Rather, the high court said the lawyers for Freedom Township resident Gene A. Davidson failed to instruct the jury that Davidson was liable only if he willfully shot the trespasser.

    DEATH: The decision reversed a court of appeals ruling, which said Davidson should get a new trial to prevent a miscarriage of justice.

    DEATH: "Parties in civil litigation choose their own counsel, who in turn, choose their theories of prosecuting and defending," Supreme Court Chief Justice Thomas J. Moyer wrote. "An unsuccessful civil litigant may not obtain a new trial based upon the bare assumption that his or her attorney was ineffective."

    DEATH: In May 1990, Davidson awoke to find two men in his yard near his pole barn. Davidson called police, ran outside and yelled at the men. As they tried to run away, Davidson fired four shots with a .38-caliber gun and fatally wounded Gregory G. Goldfuss, 22.

    DEATH: The survivor later said he and Goldfuss were trying to break into Davidson's barn to steal tools.

    DEATH: Davidson said he fired the shots to warn the men. A grand jury declined to charge Davidson, but Goldfuss' family sued.

    DEATH: A Portage County jury awarded the Goldfusses $150,000, but an appeals court reversed the decision. The Goldfusses appealed to the Ohio Supreme Court.

    DEATH: Akron lawyer David Bertsch, who argued the case for Davidson in front of the Supreme Court in January, did not return a phone message yesterday. His partner David Hilkert declined to comment, saying, "I haven't digested it yet."

    DEATH: The Goldfusses' lawyer, Don Iler, said, "Unless you propose what you think the law is [in instructions to the jury] you cannot complain afterward. That's what happened in this case."

    DEATH: Six of the seven justices agreed with the decision. Justice Evelyn Lundberg Stratton dissented in a part regarding the right to recover money for injuries suffered during a criminal act.

    DEATH: The case prompted new legislation, by State Rep. Ann Womer Benjamin, an Aurora Republican, which gives homeowners immunity from trespassers who are harmed if the property owners or renters feel their lives are threatened.
